Bill To Legalize Sports Betting At Minnesota-Based Tribes Announced 226ch

A month after the Minnesota Indian Gaming Association sent a letter to Minnesota legislative leaders opposing off-reservation sports betting, a state representative has announced that he will file a bill that would legalize sports betting on “tribal casino premises only.” Representative Pat Garofalo (R-District 58B) held a press conference Wednesday morning and shared details of the bill he plans to file on Thursday in the Democratically controlled House.

Garofalo’s bill, the Safe and Regulated Sports Gambling Act of 2019, is unique in several ways. It would legalize sports betting at tribal properties only, and wagers would be subject to an excise tax of 0.5 percent. Arizona lawmakers on Thursday will consider a similar bill that would allow tribes to offer sports betting, both on their reservations and via kiosks outside bars they own off reservation.

The per-wager tax would be the first of its kind anywhere in the country to tax, levying a tax off-the-top rather than on revenue. It would work out to roughly 10 percent of revenue. In a news release, Garofolo’s office called it “The lowest tax rate structure in the nation.” Across the country, many lawmakers have offered sports betting bills in 2019 with tax rates of 10 percent or less.

Mobile would be legal on-site plus a 20-foot zone outside tribal casinos 5ph2t

The bill doesn’t refer to “sports betting” specifically, but rather “sports pools.”

Garofalo said at the press conference to discuss it that he had shared it with tribal entities across the state, yet none has come forward in yet. The bill clearly defines mobile sports betting, which has been proven to be the biggest money-maker when it comes to sports wagering, but goes on to limit mobile betting on premises plus a 20-foot zone surrounding an Indian-owned casino.

b) The commission may grant an on-site sports pool operator license, a mobile and electronic sports pool license, or both. An on-site sports pool operator license authorizes the sports pool operator to conduct an on-site sports pool as authorized under section  240B.35. A mobile and electronic sports pool license allows the licensee to operate a sports pool wherein wagers may be placed by a person in this state by electronic means. Any portable device used in the conduct of a sports pool must include an active feature that, at a minimum, causes the device to cease functioning when the device is located 20 feet or more from the property of a federally recognized Indian tribe or group of tribe

That wording should mollify the tribes, who were clear in their January letter that they would not off-reservation sports betting.

“The Minnesota Indian Gaming Association continues to oppose the expansion of off-reservation gambling, including the legalization of sports betting.”

Whether or not the Minnesota Indian Gaming Commission will fully back Garofalo’s bill is unclear. A call to the Minnesota Indian Gaming Commission was not immediately returned on Wednesday.

“These conversations have been going on for close to a year. We’ve addressed the concerns people have brought forward to us,” Garofalo was quoted as saying by Minnesota Public Radio. “We hope this will be enough to get us across the finish line and begin that process of having these compacts negotiated.”

Garafolo has made very clear his desire to satisfy tribes in Minnesota with this new legal form of gaming:

As promised, here is a link to the language of the Sports Gambling Bill. This language has been shared with multiple tribal entities far in advance of today’s press conference. Notice that the bill was drafted back on 2/5/2019https://t.co/rucx1rygsY

In Mississippi, the state gaming commission does not oversee Indian gaming, and in New Mexico, the state attorney general opted not to oppose the the Santa Ana’s launch. But in many other states, lawmakers are working to negotiate with tribal interests, and many on both sides remain cautious.

“I think there is a good future for Indian tribes in sports betting, but it’s going to have to begin with hard and earnest negotiations with state government,” former director of the Arizona Department of Gaming Stephen Hart, told Casino Review.

Garofalo’s bill, which includes a blank spot where a number for the application fee would go, would allow for betting on professional and college sports, and would create a five-member Minnesota Sports Wagering Commission as the regulator. The bill does allow for the state to negotiate with tribes to update current compacts to allow for sports betting.

“Legalized sports gambling is not something that lawmakers should unilaterally enact,” Garofalo said in a news release. “I am committed to working with stakeholders to build consensus on a deal that works for everyone. Simply put, this cannot get done without everyone on board.”

What could Minnesota state coffers be missing out on? A lot. Consider New Jersey handle/hold numbers, also released on Wednesday. It’s a sign of the times and the potentially lost Minnesota opportunity:
